Terms of services

Welcome to Jokerthis Designs. By engaging our services, you agree to comply with the following Terms of Service. These Terms form a legally binding agreement between you and Jokerthis Designs Motorsport Graphic Services.

1. Scope of Services

We provide professional motorsport and creative graphic design services, including but not limited to:

  • Racing livery design (cars, drift, rally, endurance, etc.)

  • Helmet and race suit design

  • Brand identity creation (logos, sponsor layouts, visual identity)

  • Marketing and promotional assets (posters, banners, social media content)

  • Merchandise design (team apparel, fan merchandise, stickers, accessories)

  • Custom illustrations and digital artwork

  • Event and team presentation materials

The specifics of each project will be outlined in a written proposal or estimate.

2. Pricing and Payment

2.1 Quotes

  • All quotes are valid for 30 days from the date of issuance unless otherwise stated.

2.2 Payments

  • A non-refundable deposit of 50% is required to commence work.

  • The remaining balance must be paid upon project completion and before final files are delivered.

  • For projects exceeding 4 weeks, milestone payments may apply, as outlined in the project agreement.

2.3 Late Payments

  • Payments not received within 7 days of the due date will incur a late fee of 5% per month.

  • Persistent non-payment may result in project suspension or legal action.

2.4 Taxes and Fees

  • Clients are responsible for all applicable taxes, duties, or transaction fees related to the project.

3. Intellectual Property Rights

3.1 Ownership

  • Final deliverables become the Client’s property upon full payment.

  • Until payment is completed, all designs remain the property of Jokerthis Designs.

3.2 Portfolio Rights

  • Jokerthis Designs reserves the right to showcase completed work in portfolios, marketing materials, and online platforms, unless a non-disclosure agreement (NDA) prohibits this.

3.3 Third-Party Materials

  • If third-party materials (e.g., stock images, fonts) are used, Clients must adhere to the respective license terms.

4. Revisions and Approvals

4.1 Revisions

  • Projects include up to 5 rounds of revisions as specified in the proposal.

  • Additional revisions are billed at $75 USD per round (unless otherwise stated).

4.2 Approvals

  • The Client is responsible for reviewing and approving all deliverables.

  • Once a design is approved, additional changes may incur extra fees.

5. Deadlines and Deliverables

5.1 Timelines

  • Jokerthis Designs commits to agreed timelines, provided the Client supplies all required materials and approvals on time.

  • Delays caused by the Client may result in adjusted deadlines.

5.2 File Delivery

  • Final deliverables will be provided in agreed formats (AI, EPS, PSD, PDF, PNG).

  • Source files are available upon request and may incur an additional fee if not included in the initial agreement.

5.3 Printing Disclaimer

  • Jokerthis Designs is not liable for production or printing errors if the Client uses a third-party supplier that does not follow the supplied file guidelines.

  • If requested, Jokerthis Designs can liaise directly with the supplier or arrange printing through trusted partners (see Optional Add-On Services).

5.4 Sponsor Logos

  • All sponsor/partner logos must be supplied in vector format (AI, EPS, or SVG).

  • Logos provided in raster formats (JPG, PNG, etc.) require conversion, billed at $50 USD per logo.

  • Jokerthis Designs is not responsible for quality issues caused by low-resolution or improperly supplied logos.

6. Cancellations and Refunds

6.1 Cancellation by Client

  • Deposits are non-refundable.

  • Additional charges may apply for work completed up to the cancellation date.

6.2 Termination by Jokerthis Designs

  • Jokerthis Designs may terminate the project if the Client breaches these Terms or fails to make timely payments.

7. Confidentiality

Both parties agree to keep confidential information private unless written consent for disclosure is provided.

8. Limitation of Liability

Jokerthis Designs is not liable for:

  • Any indirect, incidental, or consequential damages arising from the use of designs.

  • Issues caused by misuse of designs, including non-compliance with trademark laws, sponsor requirements, or printing guidelines.

9. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through mediation. If mediation fails, disputes will be resolved in accordance with the laws of France.

10. Governing Law

We reserve the right to update these Terms of Service. Any changes will be communicated to Clients via email or our website. Continued use of our services constitutes acceptance of the revised Terms.
